Haiti - Politic : Toward an extension of application deadline of the law on naturalization ?

As part of Plan of Regulation of foreigners living illegally in the Dominican Republic, Chancellor of Haiti Duly Brutus, met last Wednesday in Santo Domingo his Dominican counterpart Andrés Navarro and expressed the hope that the Dominican Government, extend the period of application of the Law 169-14 [implementing decree 250-14] on the naturalization of Haitians born in the neighboring territory, which expires on October 28. Deadline justified to open new offices and accelerate the delivery of identification documents to Haitian nationals.

Miguel Medina, the spokesman of Chancellor Andrés Navarro stated that the Chancellor was awaiting formal request from Haiti to assess it and then take a decision "Around the suggestion of the Minister of Foreign Affairs of Haiti, Duly Brutus, the Dominican authorities, could grant a longer period, we wait that he do so in a formal way to examine this possibility." This request includes the duration of extension desired and the response of the Dominican Government must intervene before the deadline of 28 October.

Recall that the Plan of Regularisation of foreigners living in an irregular situation include two components, the regularization of foreign born outside the country whose deadline for the application ends in May 2015 [Decree 327-13] and the second decree 250-14 of the Regulations of the Law of 169-14 of special regime for naturalization of foreigners, with a duration of 90 days ending October 28, 2014.

In the case of naturalization the law concerns the case of children born on Dominican territory of illegal foreign parents who were registered in the register of State Civil Dominican in an irregular manner with invalid documents and in a second case children born from illegal foreign parents (between 1929 and 2007), who have never been enrolled in the Civil Status registry. This law allows persons concerned, to apply for Dominican nationality subject to compliance with certain criteria.

Recall that following the Constitutional Court (TC) 168-13 judgment https://www.haitilibre.com/en/news-9724-haiti-denationalization-the-dominican-government-accepts-the-decision-of-the-constitutional-court.html , Roberto Rodriguez Marchena, the President of the Junta Central Electoral (JCE) had disclosed Thursday, November 7, 2013, the results of audits of foreigners registered in the Dominican civil registry. The Central Electoral Commission indicated that it had found in the books of the civil state of the country that, 53.847 children of 117 foreign nationalities were registered since 1929. Of these, 29,455 children were legally registered in accordance with the regulations, because their parents were residents and held a national identification card (cedula). The majority of children of foreigners, correspond to people of Haitian descent (36.326) whose 22.689 were inscribed in a regular form and 13,672 would have been improperly with invalid documents. https://www.haitilibre.com/en/news-9834-haiti-denationalization-audit-results-of-dominican-civil-state-registers.html

Note that so far only 1,035 naturalization application were filed by Haitian and 120,000 others have registered to regularize their immigration status, since the beginning of the program launched on June 2.
