Haiti - Politic : D-2 before the recommendations of the Consultative Commission

The Presidential Consultative Commission, since its creation https://www.haitilibre.com/en/news-12615-haiti-flash-message-of-president-martelly-to-the-nation.html has already conducted several "information meetings and not of consultation" as stated Evans Paul Member of the Commission, with Prime Minister Laurent Lamothe, the Superior Council of the Judiciary (CSPJ) and the Provisional Electoral Council (CEP), the President of Senate, Simon Dieuseul Desras,parliamentarians and others personnalities. The commission plans to provide an update on his work with the press on Monday before submitting its report Tuesday, December 9, to the Head of State.

Recall the 5 types of ideas that have emerged during the 2 months of consultations between President Martelly and many players from all backgrounds, to find solutions to the pre-electoral crisis :

- A first group request to change the Prime Minister and several government ministers as a means to break the deadlock;

Regarding the resignation of the Prime Minister, who was not on the agenda of discussion of El Rancho, outside the senators on the G6 and some minority deputiues, members of the radical opposition, this solution is far from be shared by a majority of parliamentarians and the public.

- Another group asked the President to take his responsibility as Article 136 of the Constitution request itn the second of January 2015;

Choose this solution will inevitably open to endless interpretation of this article of the Constitution which states without other details on the modalities "President of the Republic, Head of State, ensures compliance and enforcement of the Constitution and institutions stability. It ensures the proper functioning of public authorities and the continuity of the State."

- A third group asked to make change in the CEP;

- A fourth trend that would be established a Constituent Assembly to address the issue of the Constitution once for all because they think the current Constitution creates too much division and requires changes after almost 30 years;

This solution causes outcry in most organizations and actors of civil society that considers "irrelevant and even dangerous this option that threaten democratic gains that the Haitian people won with hard struggle and great sacrifice "Recalling that only parliamentarians duly mandated by the people in formal elections are allowed to touch the Constitution and this in the context of two separate votes, carried out by two successive legislatures stating that no Constituent Assembly formed on a partisan basis can not replace the National Assembly.

- A final group recommends to extend the mandate of parliament or even to establish a Council that the Government must consult instead of Parliament when it takes big decisions.

Recall that the extension of the mandates would be an unconstitutional solution with respect to the establishment of a Supervisory Board it raises again strong reactions in civil society that recalls "No improvised Council can not replace Parliament which remains an essential instance of a democratic state. The formation of such Council is inconceivable that in revolutionary or insurrectionary period when all powers are collapsing under popular pressure, which is not currently the case."

Then , one can wonder what consensus recommendation, the Commission will be able to propose Tuesday to President Martelly.
