Haiti - FLASH : 19 Magistrates excluded from the judicial system

The Technical Secretariat of the Superior Council of the Judiciary (CSPJ) informs that as part of the certification process, following inquiries concerning 44 Magistrates (seated and standing), 25 were certified and 19 were not certified for breaches and various serious faults.

Among the serious faults observed, we can cite, among others : false License in Law, falsification of academic documents, lack of moral integrity and professional ethics, repeated absences, ransom of litigants, abuse of authority, lack of competence and perception of bribes...

Non-certified Magistrates are excluded from the judicial system in accordance with article 69 of the Law of 27 November 2007 on the statute of the judiciary, however, the CSPJ not having the authority to dismiss, a letter will be sent to the Head of State for the necessary follow-up regarding the dismissal of these 19 magistrates.

Note that magistrates not certified, can bring an appeal to contest the charges brought against them.

Remember that since the launch of this certification work, about 5 years ago, nearly 500 Magistrate files have already been studied.

The results of investigations on 40 other Magistrates are expected soon according to the CSPJ.
