Haiti - NOTICE : Details on disputes relating to property in the private domain of the State

Jean-Emmanuel Casséus, the Director General of the Directorate General of Taxes (DGI) advises the public in general and the farmers of the State in particular of the following points:

1. The State's farmer status does not allow them to obstruct justice;

2. Whenever justice is referred to a dispute relating to any property in the private domain of the State, the best approach is to call on the State represented by the DGI to guarantee the rights and claims held on the property of good concerned;

In addition, the DGI takes the opportunity to remind all those interested in the issue that the private domain of the State is imprescriptible (article 3 of the decree of September 22, 1964 on the "fermage" and renting of property of the private domain of the State, Le Moniteur #95). State possession therefore remains valid over these goods, despite non-use and the passage of time. It follows that no possessory action is admissible against it.
