Haiti - Justice : The PM appoints Me Jean-Joseph Lebrun as President of the Court of Cassation

On Friday November 11, in order to make the Court of Cassation functional and to solve the problem that the Superior Council of the Judiciary (CSPJ) has been experiencing for more than 2 months, which cannot incur any expenditure, Prime Minister a.i. Ariel Henry published in the official journal "Le Moniteur" special issue #31, an Order confirming the appointment of Judge Jean-Joseph Lebrun as the new President of the Court of Cassation.

However, several observers question the legality of this decision, whereas the amended Constitution of 1987 clearly stipulates "Article 175 : The judges of the Court of Cassation are appointed by the President of the Republic from a list of three (3) persons per seat submitted by the Senate [...]" two conditions which are not met in the case of this appointment...
