Emmelie Prophet-Milcé, the new Acting Minister of Justice and Public Security hhttps://www.haitilibre.com/en/news-38128-haiti-flash-ministers-of-justice-and-interior-forced-to-resign.html , faced with the degrading and inhuman situation of detainees in the various prison centers of the Country, has taken administrative measures against prolonged, arbitrary and illegal preventive detention at the level of the Public Prosecutor's Offices of the Republic in a circular addressed to the Government Commissioners and Substitutes of the 18 Jurisdictions of Haiti

Measures of the Circular :

"[...]

a) Reminds the Heads of Public Prosecutor's Offices and their Substitutes of their obligation to regularly visit Prisons, Houses of Arrest and Justice, to ensure that these environments are safe, clean and such that the health of the prisoners cannot in any way be altered. To ensure that the food of the latter is sufficient and healthy, in accordance with the provisions of articles 442,447,448 of the Code of Criminal Procedure in force https://www.haitilibre.com/en/news-37763-haiti-justice-poor-detention-conditions-threats-of-recourse-against-the-state.html

b) Enjoins the Government Commissioners to demand an overall quota of 10 indictments and indictments monthly from each Substitute assigned to his Public Prosecutor's Office, in proportion to the cases pending in each Jurisdiction and to submit a monthly report to the Ministry according to the form appended to this Circular also serving as a performance evaluation indicator.

"Failure to comply with this Circular will be considered as a breach of duty and will entail such consequences as of Law" Specifies and concludes the Minister a.i. Emmelie Prophet-Milcé.
