Haiti - FLASH : USCIS extends EADs for Haitian TPS beneficiaries

Following the decision on February 2nd, 2026, by a federal district court in Washington, D.C., to suspend the Department of Homeland Security's (DHS) revocation of Temporary Protected Status (TPS) for Haiti, initially scheduled for February 3rd ( https://www.haitilibre.com/en/news-46772-haiti-flash-tps-revocation-blocked-by-the-courts-trump-will-appeal-to-the-supreme-court.html ), U.S. Citizenship and Immigration Services (USCIS) has automatically extended the validity of the Employment Authorization Documents (EADs) of certain TPS beneficiaries in Haiti until further notice.

The agency announced these automatic extensions on its website, referring to the February 2nd, 2026, decision of a federal district court suspending the termination of TPS for Haiti, pending a ruling on the legality of the termination.

The EADs for Haitian TPS beneficiaries whose original expiration dates were February 3rd, 2026, August 3rd, 2025, August 3rd, 2024, June 30, 2024, February 3rd, 2023, December 31, 2022, October 4th, 2021, January 4th, 2021, January 2nd, 2020, July 22, 2019, January 22, 2018, or July 22, 2017, are automatically extended until further notice.

USCIS is expected to appeal the decision of Federal Judge Ana C. Reyes of the Federal District Court. Depending on the outcome of the appeal, employers could have a very short timeframe to re-verify Form I-9 and rehire the affected beneficiaries.
