Haiti - Justice : The FBH disagree with the decision of the CSPJ

Following the Assembly of the Federation of Bar of Haiti (FBH), January 25, who had decided that Me Néhémie Joseph will leave his position as representative of the FBH, within the Superior Council of the Judiciary (CSPJ) due to the end of his term of bâtonniers, followed Wednesday, January 30 of a resolution of CSPJ, reversing the decision of the FBH, confirming that Me Joseph will continue to serve on the Council as a full member, the reaction of the Federation of Bar of Haiti came quickly.

Me Carlos Hercule, President of the FBH, has protested before this decision, stating that "the CSPJ has no right to overturn a decision of the Federation of Bar of Haiti," while stating that there is no reason to create a new crisis, he urged the members of CSPJ to rise to the height of their duties and to silence their emotions and feelings.

Me Hercule recalls that Article 11 of the Law on the establishment of the CSPJ states "If a member of the Council, loses its quality while in office, there will be a replacement in the form and conditions prescribed by this Act. The one who replaces, continue the mandate for the unexpired time" while recognizing that another law is necessary to make a correction concerning the term of office of Councillors which is of 3 years to the CSPJ, while that of bâtonniers elected is of 3 years, which explains the current situation.

He announced that the FBH will meet in Assembly ext week to decide on the situation of Me Néhémie Joseph.
