Haiti - CONATEL : New decisions relating to tariff changes in telecommunications

In accordance with the legal and regulatory provisions governing the field of telecommunications in Haiti in particular, the decree of October 12, 1977 in its articles 118 and 119, the decree of June 10, 1987 in its articles 3 paragraphs d, g and h, and 7 paragraph g, and the law of August 22, 1983, Jean Marie Guillaume, Director General of the Executive Body of the National Telecommunications Council (CONATEL) informs of the following new decisions which are effective from June 1st, 2022 :

"Article 1 :

Any creation or modification of tariffs for telecommunications services, plans or commercial offers intended for the general public must be submitted for the non-objection of the Executive Body of CONATEL at least eight clear days before its application.

The non-objection is considered acquired by the operator if, before the date announced for the application of the new tariff, no reservations have been formulated by the Executive Body of CONATEL.

Article 2 :

When it deems it necessary, the Executive Body of CONATEL expresses its reservations by letter inviting the operator to present as soon as possible the arguments demonstrating compliance with the legal and regulatory provisions in the adoption of the new tariffs. In such a case, the operator suspends the application of the new tariff(s) until the decision of CONATEL which is communicated to him by mail.

Article 3 :

For the purpose of updating their files, the operators send each quarter, no later than the last day of the months of March, June, September and December, to the Executive Body of CONATEL the commercial offers or plans in application;

Article 4 :

The draft commercial offers or plans or tariffs are sent in a sealed envelope, with the mentions "confidential" and "commercial offer", addressed to the General Dirctorate of the Executive Body of CONATEL.

Article 5 :

Any person violating the provisions of articles 1 and 2 of these regulations will be sanctioned with a fine equivalent to at least half (1/2) percent and at most one (1) percent of his annual turnover for the previous fiscal year.

Article 6 :

Any person violating the provisions of article 3 of these regulations will be penalized with a daily penalty of thirty thousand (30,000) gdes per day of delay.
