Haiti - Politic : The Montana agreement proposes a new transitional power with two heads...

In a document, the Montana agreement proposes a new two-headed transitional power (President and Prime Minister) lasting 18 to 24 months, including among other things: a new National Transitional Council of 5 members responsible for appointing the President of the transition; a new Prime Minister at the head of a national rescue unity government; a body for monitoring government action; a functional judicial system, and the mechanisms for implementing this new transition proposal...

MAIN POINTS of the NEW TRANSITION:

I- Main mission of the new transitional power:

• It is imperative that the change of Government restores institutional order, on a consensual, transitional, inclusive basis and in the spirit of the 1987 Constitution, by:

- Restoration of the judicial system;

- The creation of a body to control the transition in the absence of parliament;

- The return to a two-headed executive power.

• To get the country out of this institutional, security, economic and social collapse, it is a question of organizing a national rescue government enjoying a broad consensus to carry out a non-partisan policy capable of giving all stakeholders confidence in the prospect of fair electoral competitions, acceptable to all.

• The fundamental mission of the Government during the transition period is to:

- Negotiate internationally the conditions for effective support for the Haitian security forces, with strict respect for national sovereignty, with the aim of preventing the country from sinking into a new catastrophe of military intervention;

- Restore and rehabilitate the collapsed institutions of the State and implement the transitional reforms necessary for the proper functioning of republican institutions and respect for the fundamental rights of the population;

- Restore public security conditions for a resumption of life and the reestablishment of the free movement of people and goods throughout the national territory;

- Organize a National Conference in the agenda of which the constitutional question and the political party system will be treated as a priority;

- Establish a Provisional Electoral Council, ensure the revision of the electoral system and organize general elections to renew political staff;

Strengthen state institutions to fight corruption and impunity and lay the foundations for holding trials against the perpetrators of financial crimes and blood crimes;

- Take exceptional measures to revive the economy, combat food insecurity and epidemics, organize school catch-up for children deprived of schooling over the last three years, and revive social and cultural life. These measures will be detailed in a roadmap;

- Create a Justice and Truth commission for the purposes of remembrance and reparations.

• From the political dialogue initiated more than two years ago between the Haitian parties around the resolution of the crisis, it emerges the need to re-establish a two-headed Executive at the head of the State and to put in place an inclusive Governance of National Rescue , composed of non-partisan, honest and competent personalities chosen consensually by the stakeholders of the political consensus agreement in consultation with other entities of civil society, according to objective criteria linked to the validated roadmap.

This governance will include:

- A new Prime Minister;

- An inclusive, non-partisan Government of unity and national rescue;

- A Government Action Control Body composed of x members (number to be decided by consensus);

- A functional judicial system with mandated bodies for the duration of the Transition.

II- Mechanisms for the establishment of the new transitional power:

• Stakeholders noting the resignation of the government in place sign a national political consensus agreement, which takes into account the mechanisms for replacing the resigning government and establishing the new governance of the country with a road map and a precise timetable of the Transition.

• The resigning de facto Prime Minister and his team organize the transfer of power with the transition team.

• A National Transitional Council (collegial presidency) of 5 members consensually constituted is installed. This council is formed according to the selection criteria and the mode of operation which will have been defined in the National Political Consensus. It is composed of personalities designated as follows:

1. One member from the institutional private sector;

2. One member per Diaspora;

3. One member by the Agreement of December 21;

4. One member by the political forces signatories of the Kingston Declaration;

5. One member by the Montana Accord.

• The members of this Council choose among themselves the personality who will serve as President of the Transition.

• In order to ensure that the national rescue Government, non-partisan of particular interests, is constituted in an ethical, consensual and inclusive framework, the stakeholders of the National Political Consensus proceed to the formation of an Impartial Pre-Selection Committee (CIPS) not exceeding seven (7) members of civil society, with a view to choosing the members of the other bodies of the Transition, namely the Head of Government, the Ministerial Cabinet, the Action Control Body Governmental.

The members of CIPS mainly come from:

- anti-corruption bodies;

- human rights organizations;

- organizations defending women's rights;

- peasant organizations;

- from the State University of Haiti (UEH);

- the Federation of Haitian Bars (FBH);

- of the Order of Chartered Professional Accountants of Haiti (OCPAH).

• In coordination, the stakeholders of the national political consensus constitute, on the basis of criteria linked to the mission of the new power, a list of technical and political frameworks.

• The CIPS verifies compliance with the criteria, ensures the analysis of the past of the people submitted by the stakeholders for the position of Prime Minister and retains a list of three (3) names. This committee publishes the names of the selected personalities for 3 days and then submits the uncontested list to the National Transitional Council for the official appointment of the Prime Minister.

• After the appointment of the Head of Government, the impartial Committee transmits to the National Transitional Council and to the appointed Prime Minister the list of preselected persons, according to the same procedure, to constitute the Ministerial Cabinet , in consultation with both entities.

• The impartial pre-selection committee applies the same procedure for the choice of members of the Government Action Control Body.

III - Duration of the Transition:

The Transition ends within 18 to 24 months with the installation of a President, a Parliament and the management bodies of local authorities resulting from free, honest, transparent and democratic elections."
