On Friday, May 30, 2025, the Supreme Court, seized on an emergency basis, granted the Trump administration's request and temporarily canceled the Biden Humanitarian Parole program for more than 530,000 immigrants from Cuba (110,240), Haiti (211,040), Nicaragua (93,070), and Venezuela (117,330) and ordered them to leave the country, by a vote of 7 to 2. The Supreme Court's decision is not final, but it means that migrant protections will not be in place throughout the case, which will now be referred to the First U.S. Circuit Court of Appeals in Boston. The Supreme Court's decision means the Trump administration can continue its immigration policy, even as the litigation on the merits continues in the lower courts. The dissenting votes of liberal Justices Ketanji Brown Jackson and Sonia Sotomayor dissented. Jackson accused the Court majority of "underestimating" the devastating consequences of allowing the government to abruptly disrupt the lives and livelihoods of nearly half a million noncitizens while their legal cases were pending. "Even if the Government is likely to win on the merits, in our legal system, success takes time," Jackson wrote, "and the stay standards require more than anticipated victory. I would have denied the Government’s application because its harm-related showing is patently insufficient."
