Haiti - Politic : An order strengthens the power of signature of the President Martelly

Recognizing the urgent need to implement measures in order to avoid any paralysis of public services and to release the President of the administrative delays, the outgoing Government decided, in Council of Ministers, to authorize the President Martelly to sign all documents ALONE all documents that do not require parliamentary approval, until the establishment of a new Government. By the resolution # 1 of a decree dated July 6, 2011, the Prime Minister Jean-Max Bellerive will therefore no longer required to countersign the decisions of the Head of State.

Order :

COUNCIL OF MINISTERS

Given the Articles 136, 154, 159 and 166 of the Constitution;

Considering the Decree of 17 May 2005 on the organization of the Central Administration of the State;

Given the Law of 16 April 2010 amending the Act of 9 September 2008 on the state of emergency;

Given the Order of 2 June 2004 establishing the organization and functioning of the Council of Ministers;

Given the swearing in of President of the Republic May 14, 2011;

Given the Government's resignation;

Considering the need to adopt and implement without delay public policy for the benefit of the population;

Considering that it is important to this effect, promote the expeditious adoption of acts of the Council of Ministers to allow the executive to develop appropriate responses to the situation;

Considering the urgency to implement measures to avoid any paralysis of public services;

Considering that there is place to allow the President of the Republic to take, with his sole signature, any individual act issued by the Council of Ministers which is not subject to the sanction of Parliament, until the inauguration of a new Government;

The Council of Ministers adopted the following Resolution:

RESOLUTION # 1 OF 6 JULY 2011

The President of the Republic is empowered to take, in its sole signature, any individual act issued by the Council of Ministers not subject to the sanction of Parliament, until the inauguration of a new Government.

Given to the Prime Minister's Office in Port-au-Prince July 6, 2011, 208th Year of Independence.
